Terms of Service
Article 1: Acceptance of Terms
These Terms of Service govern your access to and use of the websites, content, features, communications, donation tools, event registration tools, store purchases, product ordering, payment and shipping tools, forms, and related online services made available by the temple of harm reduction, a Nevada nonprofit corporation, and its affiliates, ministries, programs, and authorized representatives (collectively, the “Temple,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to be bound by this Agreement. If you do not agree, you must not access or use the Services.
If you use the Services on behalf of an organization, you represent and warrant that you have authority to bind that organization to this Agreement, and “you” will refer to both you and that organization.
Article 2: Scope of Services
The “Services” include our websites, online educational materials, harm reduction and spiritual resources, newsletters, community updates, donation tools, volunteer interest forms, event registration pages, contact forms, prayer request forms, and any other online products or services that link to or reference this Agreement.
The Temple’s Services are intended to support education, spiritual expression, advocacy, community engagement, and access to information relating to harm reduction and Sacred Life. Availability of specific features may change at any time.
Article 3: Mission Alignment and Religious Expression
The Temple’s Services reflect its sincerely held religious beliefs regarding the sacredness of life, the equal dignity of people who use drugs, and the spiritual importance of harm reduction practices. References to Sacred Life, the Divine, sacraments, or related spiritual concepts on the Services are expressions of the Temple’s religious mission, teachings, and values.
Nothing in this Agreement requires any user to adopt or affirm the Temple’s beliefs as a condition of accessing publicly available informational content. However, participation in specific religious rites, internal membership roles, volunteer roles, leadership positions, private community spaces, or mission-governed programs may be subject to additional standards, expectations, or participation requirements disclosed at the point of engagement.
The Temple reserves the right to interpret and administer its mission-governed activities in a manner consistent with its religious purposes, governing documents, and applicable law.
Article 4: Important Health, Safety, and Emergency Disclosures
The Services are provided for informational, educational, spiritual, advocacy, and community-support purposes only. Unless expressly stated otherwise in a separate written agreement, the Temple does not provide medical care, mental health treatment, legal advice, emergency response services, or crisis intervention through the Services.
Content available through the Services is not a substitute for professional medical advice, diagnosis, treatment, legal advice, or emergency assistance. Never disregard or delay seeking professional advice because of information you read through the Services.
If you believe that you or another person is experiencing a medical emergency, drug poisoning, mental health emergency, or immediate threat of harm, call 911, contact local emergency services, or seek immediate in-person assistance.
The Temple may provide information regarding harm reduction, drug-poisoning prevention, safer-use practices, peer support, community care, and related topics. You are solely responsible for how you interpret and use that information and for complying with all applicable laws, regulations, and safety guidance in your jurisdiction.
Article 5: Eligibility and Age Requirements
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services unless the Temple expressly makes specific content available to minors and your use is authorized by a parent, legal guardian, school, or other legally authorized representative.
By using the Services, you represent and warrant that you meet the applicable eligibility requirements and that your use does not violate any applicable law or regulation.
Article 6: Guest Checkout and Customer Accounts
You may browse the website and place a store order as a guest. You may also choose to create a customer account during checkout so you can view orders and manage saved information.
If you create an account, you are responsible for keeping your credentials confidential and for activity conducted through your account. Contact us promptly if you believe an account has been accessed without authorization. The Temple may suspend or close an account when reasonably necessary to protect customers, the Temple, or the Services.
Article 7: Donations, Payments, and Financial Transactions
The Services may permit you to purchase store products, make one-time or recurring donations, register for paid or donation-supported events, or submit other payments. All payments are processed through the payment method and payment processor presented at checkout.
By submitting payment information, you represent and warrant that you are authorized to use the selected payment method and authorize the applicable processor to charge the full amount due, including any applicable taxes or fees.
Store purchases are subject to our Returns and Refunds policy and Shipping Policy. Donations to the Temple are voluntary and generally nonrefundable, subject to the correction and review process described in the Returns and Refunds policy.
If you enroll in a recurring donation program, you authorize the Temple or its payment processor to charge your selected payment method on a recurring basis in the amount and frequency you selected until you cancel. You may cancel future recurring donations by using the cancellation mechanism provided in your donation confirmation, by contacting the Temple, or by following the instructions provided by the payment processor, subject to any reasonable processing cut-off times disclosed at the time of enrollment.
Any statement regarding tax deductibility applies only to the extent permitted by applicable law and depends on your individual tax circumstances. You are responsible for consulting your own tax advisor.

Article 8: Online Raffles and Promotional Drawings
If the Temple offers any online raffle, drawing, sweepstakes, opportunity drawing, or similar promotion (each, a “Raffle Promotion”), the Raffle Promotion will be void where prohibited and will be conducted only to the extent permitted by applicable law and consistent with the Temple’s charitable purpose. Your participation in any Raffle Promotion is subject to these Terms of Service, any additional official rules or promotion-specific terms posted or provided for the applicable Raffle Promotion, and all applicable federal, state, and local laws, rules, and regulations. If there is a conflict between these Terms of Service and the official rules for a specific Raffle Promotion, the official rules will control for that Raffle Promotion.
The Temple may limit, suspend, refuse, or cancel any Raffle Promotion, or any person’s participation in a Raffle Promotion, at any time if the Temple determines, in its sole discretion, that doing so is necessary to comply with law, protect the integrity of the promotion, address fraud or misuse, protect participants or the Temple, or respond to technical, operational, or security issues.
8.1. Raffle Eligibility and Entry Restrictions
Unless otherwise stated in the official rules for a particular Raffle Promotion, each entrant must be a legal resident of a jurisdiction in which the applicable Raffle Promotion may lawfully be offered, must be at least 18 years old or the age of majority in the entrant’s jurisdiction, and must have legal capacity to participate. The Temple may require proof of age, residency, identity, eligibility, and compliance before accepting an entry, awarding a prize, or both.
Any Raffle Promotion is subject to geographic restrictions, registration requirements, charitable gaming requirements, donation-related restrictions, and other legal limitations that may vary by jurisdiction. The Temple may reject entries from any jurisdiction, or from any person, if participation would be unlawful or would impose regulatory obligations the Temple does not elect to undertake.
Employees, directors, officers, trustees, agents, contractors, volunteers involved in administering the applicable Raffle Promotion, and their immediate family or household members may be excluded from participation if stated in the applicable official rules or if exclusion is necessary to preserve fairness or comply with law.
8.2. Donations, Entry Consideration, and No Guarantee of Winning
If a Raffle Promotion is tied to a donation, contribution, ticket purchase, suggested donation, or similar payment, the applicable promotion materials and official rules should describe the required consideration, any available alternative method of entry if required by law, and any restrictions on entries. A donation or payment does not guarantee winning, improve the odds of winning unless expressly disclosed in a lawful manner, or create any ownership or refund right except as expressly stated in the applicable official rules or as required by law.
Unless expressly stated otherwise in writing, donations made in connection with a Raffle Promotion are final and nonrefundable, subject to applicable law and the Temple’s legal obligations.
8.3. Prize Terms; Winner Verification; Taxes
Each prize is subject to availability, verification, and any restrictions described in the applicable official rules. The Temple may substitute a prize of equal or greater value if the advertised prize becomes unavailable, unlawful to award, impracticable to provide, or inconsistent with the official rules. Prizes are not redeemable for cash except where required by law or expressly stated by the Temple in the applicable official rules.
A potential winner may be required to complete and return affidavits, eligibility certifications, publicity releases, tax forms, or other documents reasonably requested by the Temple before receiving a prize. If a potential winner cannot be contacted, fails to respond within the required time, fails eligibility verification, declines the prize, or fails to complete required documentation, the Temple may disqualify that person and select an alternate winner if permitted by the applicable official rules and law.
Each winner is solely responsible for all federal, state, local, and other taxes, fees, reporting obligations, and expenses associated with a prize, unless the applicable official rules expressly state otherwise.
8.4. Publicity; Release; Limitation Relating to Raffle Promotions
To the extent permitted by applicable law, by participating in a Raffle Promotion, each entrant agrees that if selected as a winner, the Temple may use the entrant’s name, city, state, likeness, voice, statements, and prize information for winner announcements, promotional purposes, and legally required disclosures without additional compensation, unless prohibited by law.
By participating in a Raffle Promotion, each entrant releases and holds harmless the Temple and its directors, officers, employees, volunteers, agents, contractors, affiliates, successors, and assigns from and against any claim arising out of or relating to the entrant’s participation in the Raffle Promotion, the acceptance, use, misuse, or redemption of any prize, or any technical, administrative, printing, production, or other error relating to the promotion, except to the extent caused by the gross negligence, willful misconduct, or other liability that cannot be excluded under applicable law.
8.5. Technical Failures; Errors; Modification or Cancellation
The Temple is not responsible for lost, late, incomplete, misdirected, corrupted, delayed, illegible, or technically defective entries, transmissions, communications, or records, or for failures caused by hardware, software, browser, network, platform, payment processor, internet, or system errors.
The Temple may modify, suspend, terminate, or cancel any Raffle Promotion if fraud, tampering, unauthorized intervention, technical failure, legal developments, force majeure events, or any other circumstance impairs the administration, security, fairness, legality, or proper conduct of the Raffle Promotion. In that event, the Temple may, to the extent lawful and practicable, select winners from eligible entries properly received before the event requiring modification or cancellation, or take any other action permitted by law and described in the applicable official rules.
8.6. Compliance with Law; Official Rules
The Temple may publish separate official rules, disclosures, eligibility limitations, state-specific notices, donation disclosures, and winner-list procedures for each Raffle Promotion. You are responsible for reviewing the official rules applicable to any Raffle Promotion in which you participate.
The Temple does not represent that any Raffle Promotion is available or lawful in every jurisdiction. You may not participate in any Raffle Promotion if doing so would violate any law applicable to you or the Temple. The Temple may refuse, void, or disqualify any entry or award to the extent necessary to comply with applicable law, regulatory guidance, or charitable gaming requirements.
Article 9: Volunteer, Membership, and Community Participation
The Temple may offer opportunities to subscribe, volunteer, attend events, participate in community activities, request resources, or otherwise engage as a follower, supporter, participant, or member of the Temple community. Submission of a form or expression of interest does not guarantee acceptance, admission, placement, ordination, volunteer status, or access to any specific program.
The Temple reserves the right to establish and enforce eligibility criteria, codes of conduct, participation requirements, safeguarding rules, and program limitations for any community activity or opportunity.
Article 10: User Content and Submissions
The Services may allow you to submit messages, comments, prayer requests, forms, feedback, testimonials, event information, media, or other content (“User Content”).
You retain ownership of your User Content, but you grant the Temple a worldwide, nonexclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, publish, translate, distribute, display, and otherwise use your User Content as necessary to operate, improve, promote, document, and provide the Services and the Temple’s mission-related activities, subject to our Privacy Notice and any separate permissions we may request for public-facing uses.
You represent and warrant that: (a) you own or control all rights necessary to submit the User Content; (b) your User Content does not infringe, misappropriate, or violate any third-party rights or applicable law; (c) your User Content is not false, fraudulent, defamatory, harassing, threatening, obscene, or otherwise unlawful; and (d) your User Content does not include another person’s sensitive information without appropriate authorization.
We may remove, refuse, or restrict User Content at any time and for any reason, including if we believe it violates this Agreement, creates risk for individuals or the Temple, or is inconsistent with our mission, values, or community safety standards.
Article 11: Acceptable Use
You agree not to, and not to assist or encourage others to:
use the Services in violation of any law, regulation, court order, or third-party right;
use the Services for any unlawful, exploitative, harmful, fraudulent, or misleading purpose;
use the Services to encourage violence, harassment, abuse, discrimination, or self-harm;
misuse harm reduction information, safety content, or community tools in a way that could foreseeably cause injury, exploitation, or unlawful conduct;
impersonate any person or entity or misrepresent your affiliation with any person or entity;
interfere with the operation or security of the Services or attempt to gain unauthorized access to any system, account, or data;
introduce malware, malicious code, or harmful scripts;
scrape, harvest, or systematically collect content or personal information from the Services without our prior written consent;
copy, reproduce, distribute, create derivative works from, publicly display, or exploit the Services or content except as expressly permitted by this Agreement or applicable law; or
use the Services in any manner that could damage, disable, overburden, or impair the Services or the Temple’s reputation, operations, or community.
Article 12: Intellectual Property
The Services, including their text, graphics, design, arrangement, logos, names, audiovisual materials, software, compilations, and other content, are owned by or licensed to the Temple and are protected by intellectual property and other applicable laws.
Subject to your compliance with this Agreement, the Temple grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Services for your personal, noncommercial, lawful use, or for other mission-consistent purposes expressly authorized by the Temple.
No right, title, or interest in or to the Services or any content is transferred to you except for the limited license expressly granted above.
Article 13: Copyright Complaints
If you believe any content on the Services infringes your copyright, you may submit a notice to:

Your notice should include: (a) identification of the copyrighted work claimed to have been infringed; (b) identification of the allegedly infringing material and its location; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized; (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner; and (f) your physical or electronic signature.
Article 14: Third-Party Services and Content
The Services may contain links to third-party websites, tools, processors, social media platforms, embedded content, maps, event tools, donation tools, communication tools, chat tools, or other services not controlled by the Temple.
We do not endorse and are not responsible for third-party content, products, services, policies, or practices. Your use of third-party services is at your own risk and subject to the applicable third party’s terms and privacy practices.
Article 15: Communications and Electronic Notices
By providing your contact information, you consent to receive transactional, administrative, donation-related, event-related, support-related, and other service-related communications from the Temple electronically, including by email, through the Services, and, where you separately opt in, by text message.
You may opt out of marketing emails using the unsubscribe mechanism included in those communications. Text message consent, if collected, is not a condition of any donation, participation opportunity, or use of the Services, and message and data rates may apply.
Article 16: Monitoring, Interaction Technologies, and Consent
The Services may use cookies, pixels, analytics tools, embedded content, chat tools, donation processors, form providers, and similar technologies operated by the Temple or third parties. These technologies may collect information about how users interact with the Services, including page visits, clicks, form progress, device and browser information, referral information, and similar usage data.
Where permitted by law, and subject to your choices and browser settings, the Temple and its service providers may use such technologies to operate the Services, protect security, process donations, improve functionality, evaluate website performance, and support communications, outreach, and fundraising effectiveness.
By using the Services after receiving any legally required notice, and by providing consent where required, you acknowledge that certain interactions with the Services may be processed through these technologies as described in this Agreement. Your cookie and privacy choices may be managed through the tools and methods identified in this Agreement.
Article 17: Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE TEMPLE DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND SYSTEM INTEGRATION.
WITHOUT LIMITING THE FOREGOING, THE TEMPLE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, COMPLETE, RELIABLE, OR SUITABLE FOR YOUR NEEDS, OR THAT ANY DEFECTS WILL BE CORRECTED.
Article 18: Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TEMPLE AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, CONTRACTORS, AFFILIATES, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICES OR THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF THE TEMPLE AND ITS RELATED PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THIS AGREEMENT WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO THE TEMPLE THROUGH THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) US $100.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY. IN THOSE JURISDICTIONS, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Article 19: Indemnification
You agree to defend, indemnify, and hold harmless the Temple and its directors, officers, employees, volunteers, agents, contractors, affiliates, successors, and assigns from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to: (a) your access to or use of the Services; (b) your User Content; (c) your violation of this Agreement; (d) your violation of any law or third-party right; or (e) your negligence, misconduct, or fraud.
Article 20: Termination
We may suspend, restrict, or terminate your access to all or part of the Services at any time, with or without notice, for any reason or no reason, including if we believe you have violated this Agreement, created risk or potential liability, interfered with the Services, or acted inconsistently with the Temple’s mission, community safety standards, or legal obligations.
You may stop using the Services at any time. Sections that by their nature should survive termination will survive, including sections relating to intellectual property, User Content licenses, disclaimers, limitations of liability, indemnification, dispute resolution, governing law, and monitoring or interaction technology disclosures.
Article 21: Dispute Resolution; Governing Law; Venue
This Agreement is governed by the laws of the State of Nevada, without regard to its conflict of laws principles.
To the fullest extent permitted by applicable law, any dispute arising out of or relating to this Agreement or the Services will be resolved exclusively in the state or federal courts located in Clark County, Nevada, and each party irrevocably consents to the jurisdiction and venue of those courts.
You and the Temple each waive any right to a jury trial to the extent permitted by law.
Article 22: Changes to the Services or Agreement
We may modify the Services or this Agreement at any time. If we make material changes, we will post the updated version and revise the Last Updated date, and may provide additional notice if required by law.
Your continued use of the Services after the updated Agreement becomes effective constitutes your acceptance of the changes.
Article 23: General Terms
This Agreement constitutes the entire agreement between you and the Temple regarding the Services and supersedes prior or contemporaneous understandings on that subject.
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
The Temple’s failure to enforce any provision is not a waiver of its right to do so later.
You may not assign this Agreement without our prior written consent. We may assign this Agreement, in whole or in part, in connection with a merger, restructuring, transfer of assets, or by operation of law.
